Contract notice: Conclusion of non-exclusive discount agreements according to § 130a para. 8 sgb v on the active ingredient botulinum toxin (botox(r))
§130a para. 8 sgb v enables the health insurance companies (kk) and pharmaceutical companies to conclude framework discount agreements on the pharmaceuticals to be dispensed at the expense of the statutory kk. as a company for efficiency and quality, gwq is registered with kk in accordance with § 130a para. 8 p. 5 sgb v for your shareholder and customer funds. With regard to the relevant legal provisions for the award of public contracts, a regular process of active substance-related, formal award procedures takes place by GWQ Serviceplus AG in accordance with the regulations of Part 4 of the GWB. until new drug discount agreements come into force, gwq would like to conclude drug discount agreements with all interested pharmaceutical companies as part of the open-house procedure for preparations with the e.g. complete active substance. The earliest start of the contract is October 1st, 2022.gwq serviceplus ag intends to enter into non-exclusive discount agreements in accordance with section 130a para. 8 sgb v also o.a. active substance with the start of the contract on 01.10.2022. all interested companies can join this contract at any time during the contract period under the same conditions (approval model). the gwq assumes that this procedure does not fall within the scope of the cartel procurement law due to the lack of a selection decision and therefore the non-discriminatory access possibility for all pharmaceutical companies. the contract documents, the participating health insurance companies and their turnover as well as the dates for reporting the contract can be viewed and downloaded from the procurement portal of gwq serviceplus ag at http://vergabeportal.gwq-serviceplus.de. until the start of exclusive contracts, this transitional agreement is open to all market participants. If the signed contracts / declarations and evidence are received by September 10th, 2022, the first notification can be made by October 1st, 2022. The following documents must be submitted: — signed contract in duplicate, — proof of the drug approval by means of an excerpt from the public part of the amice database, — signed self-declaration (Annex 3), — list of contractual pzn (Annex 2), — declaration on regulation (eu) 2022/576 of the council of 08 April 2022 amending regulation (eu) no. 833/2014 on restrictive measures in view of russias actions destabilizing the situation in ukraine (annex 5)
